orbench Terms of Sale and License

1. What you are buying

A license that activates orbench, tied to a sign-in account created for you at checkout. The license covers one person on up to 2 machines, for personal and commercial use. If you need seats for a team, contact us. The license is perpetual for the versions released during your update window.

2. Updates

Your purchase includes app updates for 12 months from the purchase date. After the update window ends, your license keeps working on the last version released within it; renewing is optional.

3. Price and payment

orbench is sold for a one-time price, charged by Polar at checkout. The current price is shown on the pricing page and at checkout before you pay. Sales tax or VAT may apply depending on your location and is calculated and remitted by Polar as merchant of record. Prices may change for future purchases; changes do not affect completed orders.

4. Delivery

After payment, your download link and a link to set your sign-in password are delivered to the email address you gave at checkout. If the email does not arrive, check spam and then contact hello@orbench.com; we will resend it.

5. Acceptable use

You agree not to:

• share, resell, or publicly post your sign-in or license key, or use them to activate orbench for people who did not buy it
• circumvent the license check or distribute modified builds
• use orbench to violate the terms of the model providers you call through it

We may suspend or revoke a license if we believe it is being abused.

6. Refunds and cancellation

orbench is digital software delivered immediately, and we do not offer voluntary refunds after delivery. If the app is defective and we cannot fix it, contact us and we will make it right. This does not affect your statutory rights.

EU/UK consumers: you normally have a 14-day right of withdrawal for digital purchases. By starting your download and activation you acknowledge that you lose that right once delivery begins, consistent with how immediate digital delivery works. Nothing in these terms removes statutory rights you cannot waive.

7. Your responsibilities

• Benchmarks run through the model providers you configure (for example OpenRouter), on your own API key and credit. You are responsible for that usage and its costs; model pricing and billing are controlled by the provider, not us. What you send to models is your choice: check your data obligations before benchmarking on real data.
• Keep your license key and sign-in private.

8. Software warranty and support

We provide orbench with reasonable care but otherwise "as is": we do not warrant that every model, provider API change, or future OS update will work flawlessly, or that the software is error-free. We fix bugs and ship updates as part of your update window. Report problems to hello@orbench.com; attaching the app's own log (app.log, stored on your machine) helps us fix things faster.

9. Liability

To the maximum extent permitted by law:

• We are not liable for indirect or consequential damages, including lost profits, lost data, or third-party costs such as model provider usage.
• Our total liability for any claim related to orbench is limited to the amount you paid for it.
• Nothing in these terms limits liability that the law does not allow to be limited.

10. General

• Governing law: the laws of England and Wales, without regard to conflict-of-law rules. EU/UK consumers keep any mandatory protections of their home country.
• If part of these terms is unenforceable, the rest still applies.
• We may update these terms; material changes apply to purchases made after the update and are noted by date at the top.
• These terms plus your order are the whole agreement about the purchase.
